Pontoon Rental Agreement

2021 Qwest LS 822 Lanai Pontoon (115 HP) 11 Person Capacity OR 2023 Qwest M Class 8520 Lanai- RT (90 HP) 11 Person Capacity

• Weekday Rental Rate: per day $250.00
• Weekend Rental (Saturday and Sunday): per day $400.00
• Weekly Flat Rate (7 Days): Flat Rate: $1,100.00

* All additional, consecutive days are at half price of the lowest rental cost. (Example: Friday and Saturday rental would include weekend rate at $400 and ½ price of weekday rate at $125. Total rental cost of $525.)

All rentals start out with a full tank of fuel. Fuel used up by Lessee during their rental hours will be either, charged when invoiced for fuel used or prior to returning rental, to be filled up by Lessee.

1. Normal boating hours are Monday – Saturday from 9:00 am to dusk. Boat needs to be returned/picked up by 12 midnight or a hefty fee will be added.
2. Down Deposit: We will require a $500.00 down deposit when booking a rental date.
3. Cancellation: We ask that you give us a 5-day cancellation notice to receive your deposit back. If we were not notified of a cancellation, we cannot refund your deposit and it will be considered a no show.
4. Weather: If the day you rented; the weather is not cooperating. We will try to reschedule the next available time that works for you.
5. Fuel: All rentals will start out with a full tank of gas. It is the customers responsibility to refill fuel tank or we will at customers expense.
6. Checklist: A Splendor employee and the rental customer will go through and sign off on a Renter’s Boat Safety checklist / boat rental inspection before the boat goes out. When the rental returns it will be gone through again with the rental customer ensuring nothing is damaged or lost. The rental customer is responsible for all damages or missing items during their rental period.
7. NO PETS, NO TOWING, NO BOATING AFTER DARK.
8. There will be no discounts for holidays/holiday weekends.

1. The Lessor agrees to lease to the Lessee the following described watercraft and equipment (hereinafter referred to as “the Rental Craft”): 2021 Qwest LS 822 Lani (Capacity 11 persons, weight limit of 1,503 lbs).
2. In consideration of the above, the Lessee agrees to pay the Lessor a rental fee in the amount of selected rental fee per day.
3. The term of this lease shall be based on approved days, and the Lessee shall return possession of the Rental Craft to the Lessor by 12 AM by the end of the rental day.
4. The Lessee shall pay a late fee of selected rental fee for each day past the expiration of this lease that the Rental Craft is not returned to the possession of the Lessor.
5. Upon execution of this agreement, the Lessee shall pay a security deposit of $500.00 which amount shall be returned upon the expiration of the term of this lease provided the Rental Craft is returned to the Lessor in good condition, save for ordinary wear and tear.
6. In the event of any damage to the Rental Craft or malfunction of its equipment, whatever the cause, the Lessee shall immediately report said damage or malfunction to the Lessor and allow the Lessee’s security deposit to be applied toward the costs of repair. Any costs of repair which may exceed the amount of the security deposit shall be the sole responsibility of the Lessee.
7. The Lessor shall not be held liable for any damage, inconvenience, or loss of time caused by any accident, damages, or malfunction of the Rental Craft during the term of this lease.
8. The Lessee acknowledges that he/she has had the opportunity to fully examine the Rental Craft and has found it suitable for the purpose for which it is leased.
9. The Lessee agrees not to use the Rental Craft for any unlawful and/or negligent purpose, nor will the Lessee allow any other individual(s) to use the Rental Craft for any unlawful and/or negligent purpose.
10. The Lessee is aware of the potential hazards associated with the activity of boating, and by participating in said activity assumes all risk of such hazards.
11. It is the responsibility of the Lessee to operate the Rental Craft in a safe and proper manner, with due care for others, and in accordance with all relevant statutes, regulations, ordinances, and safety rules.
12. The Lessee agrees to indemnify and hold harmless the Lessor and any of its agents against any and all claims for loss of or damage to property or injury to persons – including death – resulting through the use, operation, or possession of the Rental Craft.
13. The Lessee agrees to hold the Lessor harmless for any loss of or damage to any personal property of the Lessee stored or carried on the Rental Craft.
14. The Lessor reserves the right to terminate this lease for any reason at the discretion of the Lessor.
15. The Lessee shall cover any and all legal fees and costs incurred in connection with the resolution of any dispute under or in connection with this agreement.
16. This agreement shall be binding to the fullest extent permitted by the law. If any provision of this agreement is found to be unenforceable, the remaining terms shall be enforceable.
